Update on November 11 County Council Meeting re: Proposed Shoreline Preservation Bylaw

Update on November 11 Shoreline Preservation Bylaw – Report to County of Haliburton and Response to Concerned Waterfront Property Owner Group    

 As reported in a previous eblast, the consultants have made their final report to the Haliburton County Council.  The full report (approx. 800 pages total) includes their findings and recommendations to Council, a new Proposed Draft Bylaw, and copies of all of the input that they have received through the process.  Here are the documents.

At this point, Haliburton County Council have not provided information on their next steps for the new proposed bylaw.  We are not aware of any scheduled meetings or opportunities for input.  We will continue to keep our members informed as new opportunities arise.

A Kennisis Lake group called ‘Concerned Waterfront Property Owners Group on the Proposed Shoreline By-Law’ has developed a set of recommendations regarding the proposed bylaw and has provided these to the consultants and to Haliburton County Council.  The group also approached the KLCOA Board of Directors to consider supporting their recommendations to County Council and has requested that the KLCOA conduct a referendum with our members asking specific questions regarding the proposed bylaw related to support for site alteration and the protected shoreline setback distance. The group did provide background material to support their requests.

On November 9, 2021 during the regular KLCOA Board meeting, a lengthy discussion was conducted regarding these requests and included a review of where Board stands on Shoreline Preservation in general and how the Board can best represent the KLCOA membership.  The discussion also included reviewing the results of the general survey that were related to water quality protection, shoreline preservation and education and advocacy in these areas.  The full Survey can be found here

The outcome of the discussion was that the KLCOA will continue to educate and advocate in general, for shoreline preservation, as it is one of the important contributing factors for our lake health and water quality.  The KLCOA Board also agreed to continue to advocate for healthy septic systems, encourage the restoration of damaged shorelines and to continue to perform water quality testing.  

The KLCOA Board of Directors has decided that it is not appropriate to comment on specifics of the Draft Bylaw at this time.  Since the Shoreline Preservation Bylaw has become such a contentious issue that is personal to each individual property owner, the KLCOA has determined that it cannot possibly weigh in on specific details while properly representing all members.

The KLCOA therefore, will not conduct a membership referendum on the specific aspects of the Proposed Shoreline Protection Bylaw (October 22, 2021). The KLCOA will continue to provide members with opportunities for individual input to Haliburton County as they become available.

Update on October 26 County Meeting and Final Report:

On Wednesday, October 26 at 9:00am there was a regular meeting of the County of Haliburton Council  which includes the Final Report and By-law recommendation that has been prepared by J.L Richards and Associates Ltd. and Hutchison Environmental Sciences Ltd.  This report was completed upon request from county council with respect to the proposed Shoreline Preservation By-law.

As part of the public consultation process, the Consultants (HESL and JLR) hosted a Virtual Open House in September to seek feedback on scientific literature review and options for the shoreline preservation by-law.
